　【中文摘要】本文以保险代位求偿权作为研究对象,旨在对保险代位求偿权作较为深入的分析,按照通常的逻辑方法,以保险代位求偿权的概述为出发点,先后对保险代位求偿权适用范围的扩展、保险代位求偿权的行使与保护进行分析,最后,对保险代位求偿权的实际效能进行论述。全文分引言、正文、结论三部分,作为重点部分的正文分为五章:第一章是保险代位求偿权概述。从保险代位求偿权的功能和价值着笔,定位其终极功能和价值在于法的公平与效益价值的结合,平衡了保险人、被保险人、第三者之间的利益关系。进而辨析其性质上的法定性、债权移转性、以及其请求权属性。最后再与民法其他相关概念进行比较分析。第二章是保险代位求偿权适用范围扩展之分析。首先论述我国关于保险代位求偿权适用范围的规定。其次阐述其他国家关于人身保险是否适用代位求偿权的规定。然后分析适用范围之扩展,突破“人身无价”论,从保险分类的角度进行分析,又以医疗费用保险为例。最后进行我国人身保险代位求偿权的立法完善分析。第三章是保险代位求偿权的行使。论述了保险代位求偿权行使的主要问题,包括行使名义问题,行使范围、行使对象的限制,被保险人的优先受偿原则,向第三者履行通知义务问题和保险人赔付正当性问题。第四章是保险代位求偿权的保护。依次论述了被保险人的协助义务,被保险人对第三者损害赔偿请求权的放弃,被保险人影响保险人代位求偿权实现的不利后果承担,以及保险代位求偿权的时效问题和保险代位求偿权保护方面的立法完善分析。第五章是保险代位求偿权的实际效能分析。从保险人的角度分析代位求偿权实际效能,包括保险人行使代位求偿权所要考虑的因素,保险人对代位求偿权的放弃,以及保险代位求偿权实际效能对我国保险法中代位求偿权制度的影响。

　【英文摘要】With the right of insurance subrogation as the subject of investigation, with deeply analysis for the right of insurance subrogation as the purpose of this paper, writer use the common logic method , first gives an outline of the right of insurance subrogation,followed by the expander of it抯 scope , the execution of it and the protection of it . The end, writer gives the discussion for actual efficiency and function of the right of insurance subrogation. Whole paper divides into three parts: introduction, the text, the conclusion. The text part includes five chapters.ChapterⅠstart from the function and value for the right of insurance subrogation, determine it’s function and value is the combine of the fair and benefit. Followed by nature analyze: statutory nature, transfer of creditor抯 right, right of claim, and the compare to other concept.Chapter II is the analysis on expand of scope for the right of insurance subrogation. At first, summary the China抯 legislation on the scope of the right of insurance subrogation, followed by expand of scope, breakthrough the揚ersonal priceless攊ssue, on the angel of classification for insurance, and for example of medical expenses insurance, at last, analysis for the legislation抯 perfection.Chapter III has the important issues including whose name should used in the execution of the right of insurance subrogation, restriction for execution range and object, and the insured抯 priority repayment, performing the notification obligations to the third person, and the appropriation of the insurer抯 payment.Chapter IV is the protection of the right of insurance subrogation. Followed by the assistance obligations to the insured, the insured giving up the compensation claim to the third person, the undertake of adverse consequences for the affection of the insured to the insurers?right achievement, and the statute of limitations for he right of insurance subrogation.Chapter V discusses the analysis for actual efficiency and function of the right of insurance subrogation. On the side of insurers, include the insurers抋ctual demand, the factor that the insurers should be thinking of, the insurers抋bandonment. At last, writer discussing the affection for the right of insurance subrogation in Insurance Law that caused with the actual efficiency and function of the right of insurance subrogation.
