 根据《中华人民共和国劳动法》、 《中华人民共和国劳动合同法》及有关法律法规的规定,甲乙双方经平等协商同意,自

  愿签订本合同,共同遵守本合同所列条款。

  This Contract is signed on a mutuality voluntary basis by and between the following Employer and Employee in

  accordance with the Labour Law of People"s Republic of China.

  一、劳动合同期限

 Term of the Contract:

 本合同期限类型为固定期限劳动合同

 乙方在试用期内请假次数超过

 5 天或者迟到早退超过 6 次的;

  (四)

 乙方的背景调查或者在履历中发现有弄虚作假行为的;

  (五)

 乙方顶撞上司或在工作期间发生殴斗行为的;或者其他任何主管认为乙方不能符合该职位的要求的;

  (六)

  An Employer may terminate an employment contract during the probation period if

  (1) Is proved not to satisfy the conditions for employment during the probation period;

  (2) Materially breaches the E

 mployer ’s rules and regulations;

  (3) Commits serious dereliction of duty or practices graft, causing substantial damage to the Employer;

  (4) has additionally established an employment relationship with another Employer which materially affects the completion of his tasks with the first-mentioned Employer, or he refuses to rectify the matter after the same is brought to his attention by the Employer;

 (5) causes the employment contract to be invalid due to the circumstance specified in item

  (6)

 二、工作内容

 Job Description:

 乙方同意根据甲方工作需要,承担以下职责

 三、劳动报酬

  第五条

 甲方向乙方支付薪金的期限为次月的

  第六条

 甲方根据公司的经营效益和乙方的个人表现和业绩发放奖金,奖金的数额没有明确的规定,完全根据甲方效益

  和乙方绩效来确定。

  Part A may pay bonus according to the performance of Part B

 四、劳动合同的变更、解除、终止、续订

  Termination, Modification, Renew and Discharge of the Contract

  第八条

 订立本合同所依据的客观情况发生重大变化,致使本合同无法履行的,经甲乙双方协商同意,可以变更本合同的

  相关内容。

  Due to the force majeure, The relevant clauses of the Contract may be modified by the parties.

 第十条

 经甲乙双方协商一致,本合同可以解除。

 The contract can be modified or terminated by the parties

 through

 consultation;

  第十一条

 乙方有以下情形之一的,甲方有权解除劳动合同并无须给乙方任何经济补偿金:

  (一)

 严重违反公司员工手册、人力资源管理制度、行政管理制度、岗位职责规定、上司任务安排等一系列公司规章制

  度的;

  (二)

  (三)

  (四)

  (五)

  严重失职,营私舞弊,给甲方利益造成重大损害的;

  被依法追究弄事责任的;

  乙方同时在其他地方兼职或以任何形式,对甲方的工作任务造成严重影响,或者经过甲方提出后仍不改正。

  在试用期被证明不录用条件的;

  (六)

 乙方被发现其存在虚假欺骗行为(包括但不限于其假工作经历、假学历证、假身份证明等),使甲方违背真实意

  思的情况下与乙方订立合同的;

 The Contract may be discharged by the Employer with immediate effect and the Employee will not be compensated if the employee :

 (1

 Materially breaches the Employer

 ’s rules and regulations ;

 (2) Commits serious dereliction of duty or practices graft, causing substantial damage to the Employer;

  (3) has additionally established an employment relationship with another Employer which materially affects

 the completion of his tasks with the first-mentioned Employer, or he refuses to rectify the matter after the same is brought to his attention by the Employer

 (4)The Employee is being charged with criminal offences:

  第十二条

 有下列情况之一的,甲方提前三十天以书面形式通知乙方本人或者额外支付乙方一个月工资后,可以解除劳动

  合同:

  (一)

 乙方患病或者非因工负伤,在规定的医疗期满后不能从事原工作,也不能从事单位另行安排的工作的;

  (二)

 乙方不能达到所担任岗位的绩效指标或者相应的要求的,经过培训或者调整工作岗位,仍不能达到的;

  (三)

 劳动合同订立时所依据的客观情况发生重大变化,致使劳动合同无法履行,经甲乙双方协商,未能就变更劳动

  合同内容达成协议的。

  An Employer may termi nate an employment contract

  by giving

  the

  Employee himself

  30 days’ prior

  written

  notice,

  or one month ’s wage in lieu of notice, if:

  (1) after the set period of medical care for an illness or non-work-related injury, the Employee can

 engage neither

  in his original work nor in other work arranged for him by his Employer;

  (2) The Employee is incompetent and remains incompetent after training or adjustment of his position; or

  (3) A major change in the objective circumstances relied upon at the time of conclusion of the employment contract

 renders it unperformable and, after consultations, the Employer and Employee are unable to reach agreement on amending the employment contract.

  第十三条

 乙方提前三十日以书面形式通知甲方,可以解除劳动合同,但双方有服务期约定的除外。

  A Employee may terminate his

  employment contract upon 30 days

  ’ prior written notice to his Employer. During

  his probation period, a Employee may terminate his employment contract by giving his Employer three days notice.

 第十四条

 本合同期限届满,劳动合同即终止。甲乙双方经协商同意,可以续订劳动合同;若甲方维持或者提高劳动合同约

  定条件续订劳动合同,乙方不同意续订的,甲方将根据《劳动合同法》第四十六条第

 5 点的规定不向乙方支付经济补偿金。

  The Contract may be renewed at the expiration through consultation by the parties with the fulfillment of the

  procedure within 15 days to the expiration;

  第十五条

 有下列情形之一的,劳动合同终止:

  (一)

 劳动合同期满;

  (二)

 劳动者已开始依法享受基本养老保险待遇的;

  (三)

 劳动者死亡,或者被人民法院宣告死亡或者失踪的;

  (四)

 用人单位被依法宣告破产的;

  (五)

 用人单位解散、被吊销营业执照或者责令关闭的;

  (六)

 有法律、行政法规规定的其他情形的。

  An employment contract shall end if:

  (1) Its term expires;

  (2) The Employee has commenced drawing his basic old age insurance pension in accordance with the law;

  (3) The Employee dies, or is declared dead or missing by a People

 ’s Court;

  (4) The Employer is declared bankrupt;

  (5) The Employer has its business license revoked, is ordered to close or is closed down, or the Employer decides on early liquidation; or

 (6) Another circumstance specified in laws or administrative statutes arises.

 五、劳动争议处理

 第十六条

 因履行本合同发生的劳动争议,双方应积极协商解决;解决不成,当事人一方要求仲裁的,应当自劳动争议发

  生之日起六十日内向

 __________________________劳动争议仲裁委员会申请仲裁。当事人一方也可以直接向

  劳动争议仲裁委员会申请仲裁。对裁决不服的,可以向人民法院提起诉讼。

  negotiations. In case no settlement can be reached, the case may then be submitted for arbitration to labor

  第十七条

 本合同自乙方赴甲方处报到之日起并经甲方双方签字或盖章生效,双方必须严格执行,未经双方同意,任何一

  方不得修改和变更。

  第十八条

 本合同壹式贰份,甲、乙双方各执壹份,具同等法律效力。
