上半年法院纪检监察工作总结

　 上半年法院纪检监察工作总结 XX年上半年我院的纪检监察工作，坚持以邓理论和“三个代表”重要思想为指导，按照中纪委和省市县纪委全会以及上级法院的部署要求，紧紧围绕加强党的执政能力建设,树立科学的发展观，紧扣公正与效率主题，坚持为民、务实、清廉，建立建全教育、制度、监督并重的惩治和预防腐败体系。坚持把纪检监察工作与“一心为民、公正司法”紧密结合起来，通过开展“规范司法行为，促进司法公正”和“遵章守纪、廉洁司法”主题活动，加大从源头上预防和治理腐败的力度，为提高法官队伍素质，确保以审判工作为中心的各项任务的完成，提供了强有力的思想保证和纪律保证。

　 一、基本做法和主要特点

　 强化教育，扎扎实实抓落实

　 我院党组坚持从思想教育入手，强化防范意识，注重源头治腐，始终把教育放在重要的位置。坚持利用党组中心组学习和干警集中学习的时机，有针对性地开展一系列教育活动，并在国省、市级报刊杂志上发表宣传纪检监察的文章10多篇。上半年,着重开展了六个方面的教育活动：

　 一是扎实开展“规范司法行为，促进司法公正”专项整改活动。吴院长结合反面典型给干警上警示教育课,促进了教育整改工作和规范了干警的廉政司法行为。在学习提高的基础上，干警结合自身存在的突出问题，进行了认真剖析和整改，促进了党风廉政建设教育效果的提高。

　 二是利用多种形式进行廉政教育。上半年组织廉政教育８次，其中观看廉政录相２次，上廉政党课讲座6次。具体做法是召开党组会，认真学习领会上级关于反腐倡廉的有关文件精神，研究制定切合法院实际的反腐败工作计划；召开全院干警大会，深入进行思想发动，进一步讲清新时期加强党风廉政建设和反腐败工作的重要性、紧迫性和艰巨性；开展大讨论，要求每个干警结合部门和个人的思想、工作实际，谈认识、谈体会，以增强搞好反腐败工作的信心和决心。

　 三是组织《中国共产党党内监督条例》与《中国共产党纪律处分条例》的专题学习活动。重点结合《法官法》和最高人民法院的“四项制度”等相关条规进行了学习。参加盐城市纪委在网上组织的党纪条规百题知识考试，进一步增强干警对“两个条例”知识的理解和掌握，进一步强化职业道德意识、全心全意为人民服务的宗旨意识和遵纪守法、清正廉洁意识，真正做到“权为民所用、情为民所系、利为民所谋”。

　 四是继续深入学习、贯彻《关于建立健全教育、制度、监督并重的惩治预防腐败体系实施纲要》。根据省高院和中级法院的要求，我院党组非常注重对《实施纲要》的贯彻学习。运用了网络、宣传栏、观看警示教育片、专题评论等多种形式，取得了显著的效果。

　 五是开展“遵章守纪、廉洁司法”主题教育活动，根据省、市法院的统一安排，认真进行了动员、排查整改，做到人员、时间、效果四落实。

　 二、强化管理，构建网络抓落实

　 一是进一步完善了各项制度。重新修订和完善了《关于落实XX年反腐败重点工作任务实施意见》、《建立健全教育、制度、监督并重的惩治和预防腐败体系实施纲要》的实施意见、《廉政执法执纪监督员工作职责》、《干警廉政档案制度》、《党风廉政保证金实施细则》等制度。划分了院党组、班子成员、各部门负责人和全体干警各自的责任范围。明确院党组对全院党风廉政建设负领导、监督责任。党组书记负总责，党组成员根据分工，对职责范围内的党风廉政建设负直接责任，各部门负责人对本部门干警的党风廉政建负全面领导责任。二是责任明确，层层签订了责任状。我们根据年度党风廉政建设的总体要求，重新修订了责任状的内容，院长和副院长、副院长和部门负责人分别签订了责任状。并根据“遵章守纪、廉洁司法”主题教育活动的要求，结合各部门的工作实际同全体干警签定了廉政承诺书。确保人人有责任，上下齐抓共管，左右协调联动。三是责任考核明确。在党风廉政考核过程中，注重采取“五个结合”。即：党风廉政考核与目标管理考核相结合、与实施审判监督相结合、与落实违法审判责任追究相结合、与上级对领导班子和领导干部廉洁自律的考核相结合、与广泛接受外部监督相结合。四是根据省高级人民法院的统一格式，重新建立健全了干警廉政档案，实现制度化管理的目标要求。

　 三、强化制度，一着不让抓落实

　 我院党组坚持从实际出发，运用近年来党风廉政建设的一系列成功的措施，保证了党风廉政监督工作的正常运行。如：《关于违反审判及工作纪律有关问题的惩戒规定》、《严格审判纪律若干规定》，《关于规范法官和律师、基层法律服务工作者相互关系，维护司法公正的若干规定》、《加强干警“八小时以外”行为监督管理的若干规定》、《岗位目标责任制》、《干警试岗、待岗、诫免谈话制度》等。为确保各项制度的落实，从以下几个方面抓督查工作：一是经常性的督查。院党风廉政建设领导小组办公室对干警执行党风廉政建设情况进行经常的督促检查，并采取定期和不定期的抽查。院党组书记吴敦还多次同监察室的同志一起检查党风廉政建设执行情况和执法执纪情况。院设立的“督查登记表”、“礼品登记表”、“违反惩戒规定情况统计表”，使用一直正常。二是加大节假日期间的廉政督查力度。每逢重大节日，党组都及时对干警提出具体明确的要求，重温“八条禁令”、“十个不准”等廉政规定，有效地杜绝了奢侈浪费、请客送礼等不正之风的滋生和蔓延。三是严格对违法违纪案件的督查。对被市中院督查通报的违反工作纪律的干警进行了处理。按本院《违反审判及工作纪律有关问题的惩戒规定》的相应条款扣发了岗位目标考核奖，并责成其书面作出检查，本年度不得被评先评优，对全院干警起到了一定的警示作用。四是加强了外部监督。院党组充分发挥党风廉政监督员的作用，并坚持定期不定期的走访人大、政协和有关乡镇、企业，征求对法院干警党风廉政和执法执纪的意见。还通过走访案件当事人、发放征求意见卡和接待来信来访，及时了解、掌握干警的廉政情况，发现问题及时纠正，受到了社会各界的好评。

　 我院结合“规范司法行为，促进司法公正”专项整改活动和“遵章守纪、廉洁司法”主题教育活动，积极听取各方面的意见，认真排查整改问题，确实把规范司法行为工作做深、做细、做实。一是坚持开门纳谏。采取发征求意见函，召开各种类型座谈会、个别拜访、交换意见、设立举报监督电话和意见箱等多种形式，广泛征求人大代表、政协委员及群众对法院审判作风等多方面的意见和建议。二是结合“专项”整改活动”，干警在学习提高的基础上，对查找出来的问题及时提出整改措施。三是反复查摆，有疑必查。纪检组、监察室对初步征求到的相关意见，及时进行了梳理归纳。对群众反映的问题，做到件件有着落，事事有回音，对“遵章守纪、廉洁司法”主题教育活动起到了积极的推动作用。

　 强化信访，措施到位抓落实

　 我院上半年共受理各类纪检监察信访投诉7件。其中,来信4件、来访3件。从信访来源上看，市中院徐院长交办的2件，市中院监察室转省高院交办的1件，本院院长交办的1件。从反映内容上看，其中：反映承办人在承办案件时，合伙串通原告篡改原始借据及庭审笔录的1件；反映退休人员代理案件，违反回避制度的1件；反映审判人员接受吃请的1件;反映暴力执行的1件。来访反映:咨询执行情况的1件;反映民事审理的鉴定案件1件;反映民事案件送达时上诉期被延误的1件。对信访人反映的情况，我们组织人员进行了认真的调查核实，其中:重复信访,省高院批准结案的1件;信访反映的情况失实的３件。对3名来访人员反映的情况，分别进行了调查和答复，信访人表示满意。

　 为控制和减少纪检信访投诉，我们坚持做到：一是从源头上“堵”。针对干警队伍中出现的苗头性问题和信访发生的规律，及时的抓预防性教育，运用正反两方面典型进行具体教育。二是从感情上“联”。在接待和处理纪检信访投诉时，坚持从投诉者的角度去理解思考，做到想其所想，急其所需，达到事半功倍的效果。三是从道理上“引”。分清是非、以理服人，让信访人心服口服。四是从机制上“防”。坚持从建立健全制度、机制入手，研究制定配套措施，形成一种长效的纪检信访管理机制，使纪检监察信访工作步入制度化、规范化的轨道。

　 二、存在的主要问题

　 我院上半年的纪检监察工作虽然取得了一些成绩，但也还存在一些问题。突出表现在：个别法官司法为民的观念树得不够牢，为经济发展服务意识不强，特权思想时有存在；审判管理和审判监督存在薄弱环节，一些案件审理、执行效率不高，办案质量比较粗糙;个别法官对待群众态度生硬，存在冷、横、硬、推现象；个别法官有为案件说情打招呼、接受曲线吃请的现象。

　 三、下半年的工作思路和打算

　 在下半年的工作中，将以中纪委全会精神为指导，按照省市县纪委和上级法院的部署要求，充分发挥职能作用，突出围绕“公正司法、一心为民”这个重点，坚持标本兼治，齐抓共管，加大查处违纪违法案件和从源头上预防和治理腐败现象的力度，为建设高素质的法官队伍、确保以审判工作为中心的各项任务的完成。

　 继续深入贯彻中纪委《惩治和预防腐败体系实施纲要》精神，重点抓好领导班子的党风廉政建设。院党组成员要带头执行党风廉政建设的各项规定，把廉洁自律工作与本职工作相结合，坚决执行“五不许”的规定，坚决执行《关于各级领导干部接受和赠送现金、有价证券和支付凭证的处分规定》，切实维护司法公正。

　 继续抓好党风廉政建设责任制的落实。党组要把党风廉政建设作为头等大事牢牢抓在手上，落实在行动上。领导班子和党组成员坚持做到带头廉洁自律，认真执行各项廉政规定。带头学习，增强抓党风廉政建设的主动性。带头督查，确保党风廉政建设责任制的落实。

　 继续巩固“规范司法行为、促进司法公正”专项整改活动和“遵章守纪、廉洁司法”主题教育活动”的成果，加大党风廉政建设的宣传教育力度。“七一”准备表障一批廉政模范典型，加大“反腐倡廉警示教育”宣传的力度，扩大党风廉政教育的幅盖面，促使干警始终处于“自省、自重、自警、自励”的良好状态，切实把党风廉政建设工作真正落到实处。

　 继续贯彻、执行《法官法》的“十三个不得有”和最高人民法院的“四项制度”。充分发挥纪检监察部门的职能作用，在监督和查处上下大力气，对审判人员在审判等工作中以权谋私、钱权交易、贪赃枉法的，发现一起，查处一起，决不姑息养奸。对查实的违法违纪的人和事，坚决依照“四项制度”的规定给予处理，决不“失之于宽、失之于软”。
