　改进乡镇纪委办案工作的思考

　随着我国改革开放、社会主义市场经济的发展和反腐败斗争的不断深入，反腐败工作已进一步向基层延伸，乡镇纪委的工作也显得越来越重要，加快和改进乡镇纪委查办案件工作也愈为迫切，因此，研究和探讨乡镇纪委办案工作，推动乡镇党风廉政建设和反腐败斗争的深入发展，是当前摆在各级党委和纪检监察机关面前的突出课题。

　 一、乡镇纪委办案工作的现状和存在问题。

　各级党委政府和纪委对乡镇纪委查办案件工作高度重视，采取了有力措施，乡镇纪委办案工作也取得了明显进展。但我们必须看到，乡镇纪委办案工作离市场经济的发展，离党风廉政建设和反腐败斗争形势的发展要求还有较大的差距，一些乡镇干部的违法违纪问题比较突出，有的地方有上升蔓延的趋势，而与此不相适的是乡镇纪委自办案件不多，有的乡镇甚至多年来没有办案，严重影响了党委、政府的威信，挫伤了人民群众反腐败斗争的信心。其存在的问题主要表现在：

　1、思想认识不到位。几年来 ，上级纪检监察机关对乡镇案件查办的要求越来越高，目标越来越明确，而一些乡镇党政机关领导对反腐败工作重视程度不够，对查案工作的认识不到位，在配备和使用纪检干部上不能适应新时期纪检工作的要求。有的出于照顾，为解决职级待遇而安排在纪检岗位上，有的纪检干部素质不理想，性格内向，为人处事太憨实，能力差，工作上打不开局面。不少乡镇纪委办案人员配备普遍不足，而在实际工作中，每人也身兼多职，因而变为了人数多力量不够，兼职多有备无实，纪检工作难开展，把查办案件丢一边的状况。同时有些乡镇纪检干部本身认识也较片面，认为纪检工作干的如何无所谓，做好其他工作才是实的，有的对纪检工作缺乏应有的积极性、主动性和责任心，导致工作被动应付，毫无生气，有些干部甚至还存在着查办案件会影响经济发展的顾虑，认为经济要上纪律要让，对查办案件工作不重视，不支持，影响了乡镇纪委查办案件工作的积极性。由于对乡镇纪委办案工作存在种种模糊的思想，受到这些错误消极思想的影响和支配，不时出现有案不查、查案不力、查案不果的观念。

　 2、工作作风不过硬。有些乡镇纪检干部在查办案件工作中，存在怕人家说他是“整人”的，于是宁做“老好人”不做“黑包公”，缺乏严格执纪的态度，不敢坚持原则。诚然自己能严以律已，以身作则，时刻注意自身形象，但乡镇范围小，有各种关系和工作对象，甚至每天都会见面，存在着开展查案工作必定要得罪人甚至是一批人的思想顾虑，造成对违法违纪现象不敢抓，不愿管，直等上级督办，可以把责任推到上级。对群众反映情况不能重视，没有深入开展调查研究，排查案件线索，从而出现案源少无案源，难办案，无案办的被动局面。有个别乡镇党政领导不愿查处自己管辖范围的违纪案件，怕有了案件会影响本单位争先创优工作，担心自己管辖的部门违法违纪案件暴光后受到党风廉政建设责任制的追究，影响政绩，耽误仕途升迁，因而对违法违纪行为不查不报，搞内部消化。

　 3、办案业务不熟悉。随着新的违法违纪形式和手段的不断出现，一些腐败分子为了实现其罪恶目的，在违法违纪过程中挖空心思，绞尽脑汁，不断变换作案形式和手法，在作案之初就考虑到以后问题暴露了怎么办。这些违纪形式和手段极具隐蔽性、欺骗性和破坏性，再加上一些乡镇党员干部违纪违法比较严重，社会关系比较复杂，有的甚至身居要职，这些都为案件的查办带来了深度和难度。然而就目前一些乡镇纪检干部素质状况而言，在新时期反腐败斗争中不能适应形势发展的需要，由于我们乡镇纪检干部平时查办的案件比较少，缺乏实践锻炼，业务不精，对查办违纪违法案件信心不足，办法不多，对违纪违法出现的新形式和手段把握不住，影响了乡镇案件的查办。又由于部分乡镇纪检干部是新上岗，上岗前没有系统的业务培训，上岗后未能抓紧提高自身的业务技能，在遇到案件时，他们虽有查案决心，但因业务不熟悉，办案程序不清，对成案线索不敏感，抓不住要害，以至于大案查成小案，小案查成无案，最后不了了之的局面。

　 二、强化和改进乡镇纪委办案工作的重要性。

　1、加强和改进乡镇纪委办案工作是乡镇反腐败斗争形势和任务的需要，是贯彻标本兼治、综合治理方针的重要体现。通过查办违法违纪案件，能够遏件腐败现象发展蔓延的势头，并且能有效地促进党员干部提高廉洁自律意识，自觉抵制不正之风，在思想上筑牢拒腐防变的堤防，推动从源头上预防和治理腐败工作开展。

　2、加强和改进乡镇纪委办案工作是把群众反映强烈的“热点”“难点”问题解决在基层的有效手段。切实抓好信访举报，查办案件工作，认真倾听群众呼声，可以解决乡镇基层中大量的实际问题，减少越级访、集体访，对维护一方平安，促进社会稳定意义重大。

　 3、加强和改进乡镇纪委办案工作是乡镇基层经济发展的客观要求，严肃查处乡镇基层的违法违纪案件，惩处违法违纪分子，消除经济领域的腐败现象，才能为乡镇基层的经济发展扫清障碍，从而有利于促进各项改革和经济建设的顺利进行，为经济发展提供一个良好的环境。

　 4、加强和改进乡镇纪委工作是搞好“鱼水工程”，提高基层党委、政府威信的有效途径。通过查办违法违纪案件，使群众直接、真实的了解我们党反腐败斗争的决心，使群众亲眼目睹。同时，通过查办违法违纪案件，能够更好地维护广大人民群众的合法权益，有效地化解矛盾，维护社会稳定，从而使党委、政府的威信不断提高。

　 三、强化和改进乡镇纪委办案工作的几点思考。

　 1、加强政治思想建设，解决办案认识问题。乡镇党政领导对加强农村党风廉政建设和反腐败工作要有高度认识，要清楚地理解加强农村党风廉政建设关系到农村政权稳定，社会安定，经济和社会各项事业发展的成败。同时乡镇纪委要充分认识查办案件的重要性，要在乡镇领导干部中形成“有案不查是失职，查不了案件不称职”的共识。要解决“不敢查”的问题。要正确认识查办案件在整个反腐败斗争中的地位和作用，明确只有狠抓案件的查处，才能把从严治党的要求落实到实处，凡是需要乡镇纪委去查的案件，就决不能推诿和懈怠。要树立敢查案的观念，要有牺牲精神，刚正不阿、恪尽职守、秉公执纪。变“不想查”为“积极主动地去查”，真正把查办乡镇基层办案工作作为政治上的“亮点工程”，密切党群干群关系的“鱼水工程”，维护党纪政纪严肃性的“形象工程”。

　 2、加强组织建设，解决办案力量问题。配备好专职乡镇纪委书记，同时应配备一名专职纪检干事，负责纪委的日常工作，并且还要建立健全乡镇纪委案件检查小组和案件审理小组，并针对目前有的乡镇纪委力量比较薄弱的问题，应重点抓好对乡镇纪委书记的培养、管理和使用，由上级党委和组织部门共同把关，对乡镇纪委书记的提名、任免、交流应征求纪委的意见，把不适应纪检工作的同志或多年从事纪检工作的老同志逐步交流出去，安排好，把德才兼备，年富力强适合从事纪检工作的同志充实进来，对办案出色的同志及时予以提拔任用。同时要求乡镇纪委书记把主要精力用于纪检监察工作。及时选拔政治素质过硬，思想作风正派，业务能力强并且有法律、财经、计算机等专业特长的年轻同志充实到基层办案一线，使其在实际工作中增长才干。要形成系统的纪检工作网络，一级抓一级，层层有责任，为进一步做好乡镇纪委查办案件工作提供坚实的组织保证。

　 3、建立健全工作机制，解决办案规范问题。一是要制定切实可行的查办案件工作责任制。把乡镇纪委办案工作纳入目标管理，要实行有案不查追究制，明确各乡镇党委书记为查办案件第一责任人，纪委书记是直接责任人，对违法违纪案件形成齐抓共管的格局。二是形成分片负责督查制度。由上级纪委与各乡镇建立查办案件分片负责制，书记抓总，常委包片，纪检监察室具体指导、督促、检查各基层单位及时查办案件。三是实行目标考评制度。对乡镇纪委落实办案目标责任制进行严格考核，将全年案件查办工作目标分解到具体责任人，把完成目标任务情况与年终考评相结合，对当年查办案件工作达不到要求的，所在单位不能评为党风廉政建设先进单位，乡镇纪委不能评为先进纪检监察组织，所在单位的领导应提出改进措施，对工作不称职或不适合做纪检工作的同志要及时向组织部门提出调整意见。四是建立案件通报例会制度。上级纪委对各乡镇纪委查办案件情况逐月通报，定期召开乡镇办案工作会议，分析办案形势，交流办案经验，对不办案或办案不得力的单位和个人给予批评。

　4、加强业务建设，解决办案能力问题。针对乡镇纪检业务水平不高，办案力量薄弱的问题，应在提高乡镇纪检干部的政策水平和办案能力上下工夫。一是抓好业务培训。由上级纪检部门举办培训班，或以案代训的办法，组织乡镇纪委书记和纪检干部系统学习案件检查、信访受理、案件审理等方面的业务知识，重点掌握查办案件的基本要求和方法，并结合本地区已查处的典型案件，进行全面的、细致的剖析，从中吸取成功经验。二是搞好分类指导。对无案件的着重指导他们排查案件线索；对案件线索较多的帮助他们总结经验，研究规律，提高办案质量和水平；对新上岗的同志帮助他们尽快进入角色，把握办案的基本要求；对业务素质一般的同志，帮助其拓宽办案思路，提高突破案件的水平；对业务水平较强的同志，则帮助其提高查处大要案的能力。要建立乡镇办案会商制度。凡是重要线索的初核和重要案件的调查，都要由上级纪委相关业务室与乡镇纪委共同商讨对策。上级纪委办案时，有计划地安排乡镇纪委的同志参加，在办案过程中增加感性认识，不断提高查案工作水平。

　5、注重研究，解决办案方法方式问题。加强和改进乡镇纪委办案工作，应首先解决“无案可查”的问题。重视信访举报工作，对有关检举、控告的群众来信来访要认真对待，及时处理；主动出击，对村组、镇属单位执行政策、财务管理等工作进行专项检查和专项治理，从中发现案件线索；要深入实际，深入一线群众，倾听群众呼声，善于从中发现案源。其次要解决“如何查”的问题。加强组织领导，落实包抓案件责任。要把握时机，一旦时机成熟就要立即动手。调查取证应做到真实可靠。再次是解决“处理到位”的问题。当前，乡镇办案中对一些非纪检监察对象的违纪问题缺乏必要的处理依据，造成了办案难、定性难、处理更难或以罚代处、处理不到位的问题。纠正这一问题，就要善于运用纪律处分和组织处理两种手段，对严重违纪违法而又拒不悔改的，必须从重处理；对虽有严重错误，但能够主动讲清问题的，可以从轻或免予处分；对一般性错误的，要采取思想政治工作的方法，给予批评教育，帮助其改正。对既不是党员、又不是行政监察对象的村组干部的违法问题，查清后要及时提请有关部门进行处理，并督促落实。要善于有针对性地采取措施，使所查的案件达到“件件落实、处理到位”。

　加强乡镇纪委办案的思考

　乡镇纪委作为基层党风廉政建设和反腐败斗争的一支生力军，承担着全县查办案件半数以上的任务，是保证和促进改革发展稳定的重要力量，其工作十分重要。如何加大乡镇纪委办案力度，推动农村党风廉政建设和反腐败斗争深入开展，是当前摆在各级党委和纪检监察机关面前的突出课题。

　 目前，乡镇纪委在查处案件问题上，程度不同地存在着“五怕”，一怕乡镇党委、政府领导不支持。有个别乡镇党政领导存在不愿查处自己管辖范围内的违纪案件心理，担心给本乡镇抹黑，影响政绩。二怕情面上过不去。在同一乡镇工作，低头不见抬头见。受处理后轻则给一个党纪处分，重则开除党籍，丢掉工作，甚至负刑事责任，弄得妻离子散。从情理上过不去。三怕遭到打击报复。现在一些镇、村党员干部违纪违法问题比较严重，作案手段越来越高明，越来越隐蔽，社会关系也比较复杂。有的勾结黑道上的人，有的身居要职，这些给查办案件增加了难度。四怕查处案件得罪人。查办案件的纪委干部怕人家说他是“整人”的，有的怕说以前有过矛盾，现在利用职权来“治人”，于是宁作“老好人”，不做“黑包公”！或者是抹稀泥的方法，大事化小，小事化了。五怕办错案，担风险。上级对办案质量要求越来越高，乡镇纪委人员变动频繁，不同程度存在办案经验不足、业务不熟练的问题，有人怕出错案，就宁可少办案或不办案，也不担风险。因为“五怕”，乡镇办案数量不断下降，个别乡镇甚至几年无查办案件，使农村党风廉政建设和反腐败斗争受到影响，个别违纪人员没有受到处理，损害了党在人民群众心中的形象。

　 如何进一步加强乡镇纪委办案工作，把群众反映的“热点”、“难点”解决在基层，对维护一方平安，促进社会稳定和农村经济的发展有着举足轻重的作用。我们根据这几年工作实际，认为要解决乡镇纪委在办案工作中存在的上述问题，要作到以下几点：

　 （一）、强化办案意识，积极寻找案源，解决乡镇纪委无案件情况。克服乡镇领导认为只抓好经济工作就可以“一俊遮百丑”和“经济要上、纪律要让”的错误意识，把查办案件工作作为考核基层工作的一项重要内容，落实目标责任，把办案情况作为年度考核、工作述职主要内容。进行党风廉政建设责任制检查考评时，要把案件查处情况和党政负责同志对反腐败查办案件工作的重视和支持情况作为重点内容进行考评。使乡镇主要领导肩上有担子，思想有压力，为乡镇纪委开展工作创造条件。乡镇纪委要积极寻找案源，解决“无案可查”的问题，一是重视举报工作，对有关检举控告的群众来信来访，要认真对待，及时处理；二是主动出击，对村组、镇属单位执行政策、效能建设、为民服务等工作进行专项检查和专项清理，从中发现案件线索；三是要深入实际，深入群众，倾听群众呼声，善于从中发现案源。

　 （二）、提高认识，加强督查和指导，使乡镇纪委敢于查案。乡镇纪委要正确认识查办案件在整个反腐败斗争中的地位和作用，明确只有狠抓案件的查处，才能把从严治党的方针落到实处，认识到该查的案件不查或不认真查，该查好的案件没有查好都是一种失职行为，要树立敢查案观点，要有牺牲精神，刚正不阿、恪尽职守、秉公执纪。变“不想查”为“积极主动地去查”，把查办案件工作作为政治上的“亮点工程”，密切党群干群关系的“鱼水工程”，维护党纪政纪严肃性的“形象工程”。同时要加强对乡镇办案的督查和指导，由于乡镇办案受地方保护和裙带关系等因素影响较大，应层层加大案件督查、督办的力度，帮助排除对办案工作的干扰。

　 （三）、讲究方法，依纪依法办案。一是加强组织领导，落实包（抓）案责任，对重点案件要明确查办案件的主管领导、人员和查结时限；二是把握时机，一旦时机成熟就立即动手，力量不够可以提请上级纪委配合；三是调查取证应做到真实可靠，取证前要充分准备，尊重客观事实，证据收集要全面，不能轻意放过任何细节，询问当事人不逼供、不诱供，保证证据客观、公正、真实。四是严格按照“事实清楚、证据确凿、定性准确、处理恰当、手续完备、程序合法”二十四字办案基本要求，加强县纪委对乡镇纪委所办案件的协审工作，努力做到每个环节不少，每个步骤不丢，每项工作到位，每项要求落实。五是由于乡镇纪委办案力量较薄弱，对于复杂或疑难案件难以独立完成，因此，要建立案件协查制度，由上级纪委直接派人下乡指导，协助调查或是组织邻边乡镇纪检干部到案发单位帮助调查。

　 （四）、根据情况，讲究策略，使所查案件处理到位。当前，乡镇纪委处分的一般乡村党员干部居多，且大多数为党纪处分，往往是处分决定下达后，就好象完成任务了，把处分的送达、宣布等工作做得不够到位。而对一些非纪检监察对象的违纪问题缺乏必要的处理依据，造成了办案难、定性难、处理更难或以罚代处、处理不到位的问题。纠正这些问题，就要善于运用纪律处分和组织处理两种手段，要有针对性地采取措施，使所查的案件达到“件件落实、处理到位”。处分的送达、宣布等，是维护党纪国法的严肃性，惩戒违纪人员和教育警示其他党员干部及监察对象的重要手段，同时也是对党纪国法的一种宣传，必须按规定认真完成。对既不是党员、又不是行政监察对象的村组干部的违法问题，查清后要及时提请有关部门进行处理，并督促落实。

　进一步加强和改进乡镇纪委查办案件工作的思考

　随着形势的发展和反腐败斗争的不断深入，反腐败工作已进一步向基层延伸，乡镇纪委工作越显重要，加强乡镇案件查处工作对于促进反腐败斗争的全面深入，维护农村稳定，促进农村经济的发展都具有积极的作用。总的来说，近几年来我区各乡镇纪委在党委和区纪委、监察局的指导下，在查处乡镇基层党员、干部违纪违法案件方面取得了可喜的成绩，严肃认真地查处了一批党员干部的违法违纪案件，有效地促进了我区反腐败斗争的开展，但是，我们也发现乡镇案件查办工作发展很不平衡，全区2000年以来乡镇自办案件共只有24件，多数乡镇纪委查案工作多年来一直在低水平上徘徊，2002年三分之一乡镇全年没有案件，个别的是二三年没有办案，一些基层党员干部的违法违纪问题没有得到及时查处，影响了农村党群关系、干群关系，影响了农村的安定团结,导致了近年来农村重复举报、越级信访、群体上访量明显上升，影响了市、区两级正常工作的开展。认清乡镇办案中存在的问题，分析乡镇案件查办工作滞后的原因，探讨如何强化基层执纪办案力度的措施，把群众反映强烈的“热点”、“难点”问题解决在基层，对维护一方平安，促进社会稳定意义重大。

　一、当前乡镇纪委办案中存在的问题及原因

　1、认识上有差距，力量上不适应。近几年，上级纪检监察机关对基层案件查办的要求越来越高，目标越来越明确，而基层一些党政机关领导对反腐败工作重视程度不够，对查案工作仍认识不到位，在配备和使用纪检干部上不能适应新时期纪检工作的要求。乡镇纪委干部存在缺额多、兼职多、调动多的“三多现象”。有的出于照顾，为解决职级待遇而安排在纪检监察岗位上；有的纪检干部素质不理想，工作上打不开局面；有的兼职过多，未能把主要精力放在本职工作上，缺乏职责意识；有的新手政治上不成熟，担当不起纪检工作这个位置等。同时有些街镇纪检干部本身认识也较片面，认为纪检工作干的如何无所谓，做好其他工作才是实的、硬的、有用的。有的同志甚至还存在着查案会影响经济发展的顾虑，认为“经济要上，纪律要让”，对案件工作不重视、不支持，影响了乡镇纪委查案积极性。

　2、怕得罪人，思想作风不过硬。在查办案件工作中，存在老好人思想，怕字当头，不愿叫真，缺乏严格执纪的态度，不敢坚持原则。虽然自己能严以律己，以身作则，时刻注意自身形象，但乡镇范围小，有各种关系和工作对象，甚至每天都要见面，存在着开展查案工作必定要得罪人甚至是一批人的思想顾虑，造成对违法违纪现象不敢抓，不愿管，直等到上级督办，可以把责任推到上级，出现“专抓死老鼠”的现象，工作上很被动。一些基层单位的负责人怕有了案件会影响本单位争先创优和年度考核工作，担心自己管辖的部门违法违纪案件曝光后受到党风廉政建设责任制的追究，影响政绩，耽误仕途升迁，因而对违法违纪行为不查不报，用组织处理代替党纪政纪处分，搞“内部消化”。

　3、业务不熟悉，办案程序不清。当前纪检监察工作可以说面临着三多：一是新任务多，二是新问题多，三是新知识多。随着新的犯罪形式和手段的不断出现，一些腐败分子为了实现其罪恶目的，在犯罪过程中挖空心思，绞尽脑汁，不断变换作案形式和手法，呈现智能型犯罪，在作案之初就考虑到日后问题暴露了怎么办，这些犯罪形式和手段极具隐蔽性，欺骗性和破坏性，为案件的查办带来了深度和难度。然而，就目前乡镇纪检干部素质状况而言，在新时期反腐败斗争中不能适应形势发展的需要，一方面，我们基层纪检干部平时查办的案件比较少，缺乏实践锻炼，业务不精，对查办违法违纪案件信心不足，办法不多，对违法违纪出现的新形式和手段把握不住，影响了基层案件的查处。另一方面，现在纪检监察干部队伍中新同志多，尽管他们工作很努力，但由于业务不够熟悉，缺少查案的基本功造成办案程序不清，对案件线索不敏感，抓不住要害，以至于大案查成小案，小案查成无案，最后不了了之。

　 4、主动性不足，深究不够。来信来访、效能监察以及开展专项清理，这些工作都是发现违纪线索的重要渠道，但在实际工作中，由于有些纪检干部立案意识不强，深究不够，跑掉了一些案子。一是守株待兔，坐等群众举报，很少深入到掌管人、财、物的部门和其他容易发生问题的部位开展调查研究，查找违纪线索，不注意透过管理混乱的现象，看到违法违纪的实质。二是纪检监察工作处于“自我循环”的工作状态，与有关业务部门缺少彼此间的沟通和信息交流，缺少大纪检观念。

　 造成这些问题的原因固然很多，但我们认为，主要是以下几种情况所致：一是机构改革后，编制体制和工作机制发生了变化，有些关系还不够顺，运行机制不够完善。二是乡镇党政领导包括纪委书记的思想观念和工作方法跟不上飞速发展的形势，适应不了市场经济条件下出现的新情况新问题。三是有的乡镇纪委书记、纪检干部不注意学习，思想业务素质不高。

　二、强化乡镇纪委办案工作的几点思考

　针对基层执纪办案中存在的问题，就如何加强基层执纪办案的力度，提升乡镇自办案件的数量、质量，应从以下几个方面来尝试、加强。

　 1、加强队伍建设，解决办案力量问题。针对目前有的乡镇纪委力量比较薄弱的问题，应重点抓好对乡镇纪委书记的培养、管理和使用，由上级党委和组织部门共同把关，对乡镇纪委书记的提名、任免、交流应征求纪委的意见，把不适应纪检工作的同志或多年从事纪检工作的老同志逐步交流出去，安排好，把德才兼备，年富力强适合从事纪检工作的同志充实进来，对办案出色的同志及时予以提拔任用，同时要求乡镇纪委书记把主要精力用于纪检监察工作。在配强乡镇纪委书记的同时，还要配备好专职纪检干部，及时选拔政治素质过硬，思想作风正派，业务能力强并且有法律、财经、计算机等专业特长的年轻同志充实到基层办案一线，使其在实际工作中增长才干。在全区形成系统的纪检工作网络，一级抓一级，层层有责任，为进一步做好乡镇查办案件工作提供坚实的组织保证。

　 2、建立健全工作机制，解决办案规范问题。一是实行责任目标，完善考核制度。每年由区纪委制订要制定乡镇纪委查办案件工作目标责任制，年终进行考核，明确乡镇纪委书记为第一责任人，各乡镇纪委书记向区纪委、监察局立下“军令状”。办案较差者要向区纪委说明原因；有案不办而出现空白者，区纪委建议组织部门和区委对责任人给予就地免职。二是实行目标考评制度。将全年案件查办工作目标分解到具体责任人，把完成目标任务情况与年终考评相结合，对当年查办案件工作达不到要求的，所在单位不能评为党风廉政建设先进单位，纪委不能评为先进纪检监察组织，所在单位的领导应提出改进措施，对工作不称职或不适合做纪检工作的同志要及时向组织部门提出调整意见。三是建立案件通报制度。上级纪委对各乡镇纪委查办案件情况逐月通报，定期召开乡镇办案工作会议，分析办案形势，交流办案经验，对不办案或办案不得力的单位和个人给予批评。四是创优环境，做好服务。针对乡镇纪委在办案中遇到的各种困难，区纪委领导及时与乡镇党委沟通、协调，争取党委的支持和配合。
