　 法制股上半年工作总结及下半年工作计划

　2011年上半年以来，在县委、县政府及市局的正确领导下，我局法制工作以规范执法行为、强化执法监督、提高依法行政水平为核心，以深化行政指导、加强教育培训、依法行政为工作重点，坚持树立“法制工作全局化，全局工作法制化”的理念，深入贯彻落实科学发展观，在创新中推动发展，在发展中实现转型，认真开展了法制培训、行政指导，“政德建设落实年”活动等工作，取得了明显成效，现总结如下：

　一、抓好教育培训工作，提高队伍综合素质。

　（一）创新学习方式方法，加强干部队伍素质教育。今年工商局从抓干部培训教育入手，狠抓基层队伍建设，积极转变教育培训方式，变灌输式的“讲大课”，为灵活的“开小灶”，因需施教开展“面对面”、“手把手”的干部培训教育活动，沧县工商局共开展了三次培训活动，内容涉及到执法转型大问题及小问题梳理和解决的注意事项，查办案件的立销案审批备案制度，制作法律文书、收集证据、采取强制措施、行使行政处罚自由裁量权等方面，《食品安全法》及实施条例、《农资市场生产资料管理办法》等新近颁布实施及同我们执法实际密切相关的法律知识。与此同时，法制股积极响应市局的号召，组织各分局及业务股室的业务骨干去市局进行学习培训。通过培训学习，执法人员在培训中了解了工商法律法规的基本内容，在交流中掌握了学以致用的方法和技能，在办案技能、规范制作各种案件材料方面有了长足的进步。

　 （二）积极开展普法宣传活动。一是部署开展了“法律六进”活动。为了推动法制宣传，工作贴近基层，贴近群众，在全县范围内开展了“送法下乡”、“送法进校园”、“送法进企业”活动，取得了良好效果；二是结合系列活动日开展主题宣传活动。以3.15国际消费者权益日为载体，广泛开展消费维权法律知识宣传，结合“4.26”知识产权宣传日，与相关部门密切配合采取有效措施，开展相关主题活动，形成普法的规模效应。三是组织执法人员参加县政府法制办组织的执法备案和司法局实施的执法人员考试。法制股积极组织开展普法宣传活动，有效的加强了工商法律法规的宣传教育力度，为我县工商执法创造了良好的法律环境。

　 二、行政指导工作取得新进展。在全面深入推行“登记事务助导、查处违法疏导、规范经营劝导、维权兴企引导”四项指导机制的基础上，法制股采取了“三结合”推行行政指导。

　（一）是行政指导与市场巡查相结合。把推行行政指导作为监管创新的重要举措抓紧抓实，针对经营者的不同违法行为给予不同的行政指导，并将书面行政提示、行政告诫、行政约见和行政建议建立相关台账并归档，作为市场监管的参考依据。

　（二）是行政指导与日常业务相结合。在查处违法行为等日常业务过程中，注重发挥行政指导的积极作用，将行政指导作为日常工商行政管理业务的主要内容，努力建立了行政指导与行政许可、行政强制、行政处罚等传统管理模式并行的工作机制，促进工商行政管理职能全面发挥。

　（三）是行政指导与专项整治相结合。在开展的农资、食品等专项检查整治的过程中，将行政指导与依法处理各种违法违规行为结合起来，把推行行政指导作为规范市场经营秩序、维护公平竞争的重要手段。以人为本，重在规范，努力加强对行政相对人的事前引导和指导，降低管理成本，健全监督管理长效机制。

　“三结合”措施达到了“事先指导、事中规范、事后巩固”的行政管理目标。截止目前，我局共下达了行政指导文书337份，实现了行政指导由点至面的工作普及和推广，有效地促进了工作的开展。

　三、“政德建设落实年”活动开展取得成效。

　我们法制股着力突出两字加强政德建设。

　（一）“学”字当头，夯实政德建设基础。从建立“学习型”机关入手，通过深入学习马克思主义中国化的最新理论成果，学习党的历史经验，学习党的路线方针政策和国家法律法规，塑造良好品质，增强干事本领；按照“干部培训以德为先”的要求，完善了培训机制，把政德作为党员干部培训的重要内容，开展多层次、多形式的教育培训，使党员干部自觉践行政德要求。政德考察重在考实。始终将考察的真实性作为完善政德考察的准则把政德考察作为政德建设监督约束的一项措施落到实处对干部日常工作业绩进行考察，还要加强对干部“生活圈、社交圈”进行考察，以全面了解干部实际工作及工作以外的表现方面 学习就是抓工作，抓培训就是抓人才”的指导思想贵穿法制 建设始终，在全系统形成人人手中学法，人人心中用法的良好氛围。

　二、做好网上案件核审，提高案件核审效率。加强对执法人员使用行政执法网络系统培训力度，确保每一起案件从网上核审。

　三、全面推行行政指导工作。在继续健全完善行政指导规程、流程等制度的基础上，将行政指导工作日常化、规范化，使工商

　部门服务地方经济发展的的职能进一步强化。

　四、加强制度建设。进一步健全疑难案件集体讨论制度，提高基层执法人员素质；将市场监管及行政执法的各项职责与责任追究紧密联系起来，使行政执法责任制真正落到实处，切实做到

　“有权必有责、用权受监督、违法要追究、侵权要赔偿”。

　 总之，法制建设是工商工作的一项基础性工程，法制股将充分履行职能，围绕执法转型工作积极探索依法行政工作的新经验、新方法、新途径，努力全面提升工商行政管理工作的水平，积极促进沧县经济的又好又快发展。
