  关于强化机关党内监督的思考

  机关党内监督问题,是机关党的建设和机关自身建设的一个重大课题。机关党内监督是机关党组织运用自身力量,依据党规党法进行自我约束、自我完善的一项重要的党内政治生活活动,也是一种预防和修正错误的机制。本文试图对机关党组织在改革开放和发展社会主义市场经济的新形势下如何强化机关党内监督的有关问题,作一些研究和思考。

  一

  应认真学习邓小平建党理论和党中央、中纪委有关指示精神,充分认识进一步强化机关党内监督在机关党建工作中的重要性和紧迫性,认识其对搞好机关建设的十分重要的意义。

  强化机关党内监督是保证党的路线、方针、政策正确贯彻执行的基本条件。各级党政机关担负着国家政治、经济、文化和社会宏观管理的职能,在贯彻执行党的路线、方针、政策方面起着重要作用。党要完成自己每个时期的任务,必须有一套与之相适应的路线、方针和政策,而要使之有效地全面贯彻落实,除用制度作保证外,尚需要通过强化机关党内监督的办法来协调所有党员的行为,从而保证每个党员在行动上与中央保持高度一致。机关党的建设的历史反复证明,有了正确的路线,又有健全的机关党内监督机制,机关党组织的战斗力才有可能得到有效发挥。反之,如果机关党内监督机制受到破坏,不仅会削弱机关党组织的战斗力,也会使党的事业遭致失败。

  强化机关党内监督对建设一支经得起“三个考验”的机关党员队伍起着保证作用。机关中的党员干部能否经得起执政、改革开放与发展市场经济和反“西化”、“分化”的考验,直接关系到党的生死存亡和实现社会主义现代化大业的重要问题。当前,我们的国家正处在新旧体制的转换过程中,在领导、制度、法律等方面一时还不够完善。对于直接掌握和支配很大一部分权力的机关党员干部来说,若没有机关党内监督形式作监督基础,就很容易产生脱离群众的官僚主义作风和以权谋私等腐败现象。同时,西方资本主义国家对我进行“西化”、“分化”的图谋一刻也未停止,渗透与反渗透、颠覆与反颠覆的斗争是长期的。由于各级党政机关在国家政治、经济、文化和社会管理等方面所处的特殊地位,资本主义势力总是把它作为在中国实现“西化”、“分化”的重要突破口,总是把党政机关工作人员特别是党员干部作为争夺对象。因而,各级机关党组织要高度重视对机关党员的教育和监督,坚决挫败国际敌对势力对我进行“西化”、“分化”的阴谋。

  强化机关党内监督对机关党组织内部民主起着保障作用。党内民主为党内监督提供前提和基础,党内监督又为党内民主提供保障。党员有选举权、被选举权、批评权、建议权、申诉权和控告权等,这些权利能否得到实现,与党内监督是休戚相关的。有了党内监督,党员就可以借助组织的力量维护自己的权利和监督他人。党员的民主权利只有同党内监督联成一休,才具有稳定性,走向制度化。党内监督可以保证党员的总体意志,维护民主生活的规范。若一个党员的行为越出这个规范,他就破坏了其他党员的正当权利和党内正常生活,此时,党内监督就要以各种措施予以规劝、纠正,以保护大多数党员的正当权利和正常生活。

  强化机关党内监督是保持机关和机关广大党员同人民群众联系的一个重要措施。人民群众是历史的创造者,是推动历史前进的真正动力。保持同人民群众的血肉联系是我们党的生命所在,是力量的源泉和真正优势,也是我们进行改革和现代化建设的必备条件。各级党政机关是党和国家与人民群众联系的一个重要枢纽;同时,人民群众也往往是通过这些机关及其工作人员的工作状况和言行来看待与评价我们的党和政府。因此,保持同人民群众的血肉联系,一靠党制定和执行一条正确的路线,二靠我们发扬党的优良作风。而正确路线的制定、执行和党的优良作风的发扬,都需要党内监督作保证。实践经验证明,通过强化机关党内监督,就能不断提高机关全体党员的思想政治素质,增强抑制腐朽思想侵蚀的免疫力,保持共产党员的崇高品德;就能制止各种不正之风的蔓延,有利于党的优良作风的发扬,从而加强与人民群众的血肉联系。

  强化机关党内监督也是帮助机关党员特别是领导干部勤政廉洁、健康成长的需要。从总的情况看,我省各级党政机关中的绝大多数党员和领导干部是坚持党的基本路线,是讲学习、讲政治、讲正气的,但也存在一些令人担忧的问题。少数党员干部对坚持党的基本路线和共产主义理想持怀疑态度,在大是大非问题上头脑不清醒,立场不坚定。据四川省纪委1995年底统计,违纪案件中涉及县处级领导干部397人,地厅级领导干部15人;贪污贿赂问题涉及县处级领导干部142人,地厅级领导干部4人。在我们机关党员和干部队伍中之所以出现这些问题,其根本原因是他们自身忽视世界观、人生观的改造,同时,也与我们机关党组织监督不力有很大关系。因此,只有不断强化对机关党员特别是领导干部的监督,运用多种手段约束和规范他们的行为,才能促使他们正确地行使手中的权力,全心全意为人民服务。

  二

  弄清机关党内监督的实质,明确机关党内监督的原则,把握机关党内监督的内容,对于建立健全机关党内监督机制,强化机关党内监督,有着很强的导化作用。

  党政机关的党员干部,尤其是领导干部都掌握着一定的权力,在自己掌管的一部分事业里,有发号施令的权力,支配人、财、物的权力,任用干部的权力等。党章对党员干部行使权力是有规定、有约束的。《党章》规定:“中国共产党党员永远是劳动人民的普通一员。除了制度和政策规定范围内的个人利益和工作职权以外,所有共产党员都不得谋求任何私利和特权。”但是,在现实生活中,我们党政机关确有少数党员干部违反了这一规定。如贪污受贿、敲诈勒索、侵吞公物、徇私枉法、超标准建房、多占房、占好房、搞近亲繁殖等问题,都与权力有关。由此说明,权力的行使,在不同的人身上会有不同的结果。监督制约权力,使上述不正之风和为政不廉的问题得到制止和纠正,那么监督才算抓住了根本。现在群众中流传“有权的想干什么就干什么,有钱的想吃什么就吃什么,无权无钱的想说什么就说什么”,其实就是批评权力不受约束的现象。因此,对党政机关的党员干部,特别是领导干部,如何用党的纪律来约束,防止他们滥用职权,这应是机关党内监督必须解决的一个重要问题。可见,机关党内监督的实质就是以党章为依据,按照从严治党的要求,进行自我约束和自我完善。其重点是各级党政机关的领导干部,特别是党政一把手。

  为强化机关党内监督,完善机关党内监督制约机制,必须坚持以下三原则。一是求是原则。共产党员无论何时何地,对人对己都要尊重事实,服从真理,按照事物本来面貌如实地向党反映情况,是则是,非则非,绝不歪曲事实,掩盖真相,说假话。开展批评、检举、控告也要诚心诚意,切忌以监督之名,行诬陷、诽谤之实。二是平等原则。在党内,所有党员都是平等的同志,无论是一般党员还是领导干部,都要以平等的态度待人,必须坚持在真理面前人人平等,党内决不允许有不受党纪国法约束或凌驾于党组织之上的特殊党员。三是群众性原则。机关党内监督的群众性是由党员活动的广泛性所决定的,这是因为党员都是工作和生活在群众之中,他们的一言一行、一举一动,都避不开群众的耳目。在党规党纪日臻完善的情况下,群众更能以此为准绳,衡量党员的言论和行动,进行有效的监督。群众性原则的实施,必然使机关党内监督形成多层次、多渠道、多角度的监督机制,同时也是加强机关党的建设的一种有力手段。

  根据党章及有关规定和机关本身特点,机关党内监督的内容主要应包括:(1)监督党员和领导干部是否在学习和贯彻党的路线、方针、政策中起表率作用;在政治上、思想上是否同党中央保持一致;是否具有坚定的共产主义信念,坚持走建设有中国特色社会主义的道路;是否能够以开拓创新的精神,努力做好本职工作,积极带领群众投身改革和建设的实践,并取得一定实绩。(2)监督党员和领导干部是否严格遵守党的各项规章制度,坚持发扬民主,认真开展批评和自我批评;是否执行党的决议,遵守党的纪律和国家法令,做到令行禁止,顾全大局,维护党的团结和统一;是否廉洁勤政,严于律己,不以权谋私,不搞特殊化,自觉地过好金钱关、名位关、权力关、人情关、美色关,保持清正,拒腐防变;是否正确执行党的干部政策,不任人唯亲;是否严格执行经济法规,不谋取非法经济收入。(3)监督党员和领导干部是否深入基层,深入实际,注意听取各方面的意见,重大问题是否经过民主讨论决定,不独断专横;是否密切联系群众,关心群众疾苦,坚决维护人民群众的利益,切实保障群众的民主权利,接受党组织和群众的监督;是否有一个好的思想作风和优秀的道德品质。(4)监督党员和领导干部是否在党内以普通党员的身份处理个人与组织的关系;是否关心党的建设,积极完成党组织分配的工作;是否正确处理个人、集体和国家三者之间的关系,做到个人利益服从集体利益,局部利益服从国家利益;是否在工作和社会生活中发挥先锋模范作用,教育好自己的亲属和身边工作人员。

  近年来,机关各级党组织认真学习邓小平建党理论和党中央、中纪委有关指示精神,在加强机关党内监督方面做了大量工作,并取得了一定的成绩。但是,在机关党内监督问题上仍存在许多薄弱环节,亟待加以解决。

  有的机关党组织、党员在市场经济中把商品交换原则引入党内政治生活和机关工作中,淡化了党的观念,放松了学习,对机关党内监督缺乏全面了解,产生了种种模糊甚至错误的认识。一是“与己无关”。他们认为监督是党组织的事,上级的事,是纪委的事,对一些不良现象视而不见,充耳不闻,更谈不上进行坚决斗争。二是“不懂”。有的党员不懂得自己既是监督者又是被监督者,表现为既不洁身自好、接受监督,又不积极履行监督他人的职责。三是“不要”。他们认为,改革开放就是放开手脚,监督就是妨碍经济发展,对组织和群众的监督不以为然,或一听说监督就反感;少数党员领导干部把党组织和党员群众的监督看成是与自己过不去,是找岔子,挑毛病;还有的把被监督与不信任、受监视、看管、整人等同起来,看成是不光彩的事,忌讳监督。四是“不敢”。有的不敢监督,怕字当头。认为“得罪了领导给穿‘小鞋’,得罪了同级帮手少,得罪了下级选票少,得罪了有权部门利益少”。按照党章规定,领导干部召开民主生活会前,机关党组织应征求党内外群众的意见。然而,就我省内江市委组织部一次调查的情况来看,能征求的仅占%,完全没有征求意见的达%。领导干部对群众反映的问题持重视态度也只有%。监督意识的淡薄,必然影响监督的效果。

  由于现行监督机构管理体制不健全,监督机构还很难有效地实施监督。一是监督机构缺乏独立性,使监督受到行政领导制约。在现行体制下,机关党组织和纪检组织实际上已成为行政机关的一个部门,像人员编制、经费、人事安排、奖惩以及一些重要活动,都要由行政领导来决定,要求机关党组织和纪检组织实施对行政领导的监督确实很难。二是干部的管理使用和监督脱节,使监督缺乏强制性和约束力。管理使用者往往只注重干部的才能,而监督者又往往只注重干部的品德,加之有的单位在提拔、任免、调动干部时,不听取监督部门和机关党组织的意见,从而使之成为无效监督。例如,据重庆市直属机关工委对市级31个单位的调查,其中有13个单位的机关党组织未参与本单位干部的考核和任免工作,占被调查对象的%。三是因为利益关系的一致性,削弱了监督人员的自觉性。由于监督部门工作人员的工资、奖金、福利待遇、工作环境与本单位形成了一个利益共同体,单位利益的得失直接关系到个人利益的得失,因而很难使他们以牺牲个人利益和本单位利益为代价,压滤机滤布去维护党性原则和国家利益。

  机关党内监督是一项系统工程,需要有健全的制度进行规范和保障。但现在却没有一套健全完善的监督制度。一是有的制度本身不完善、不具体,不好操作,或者不配套,往往只规定了应该怎么办,不准怎么办,而对违反了怎么办却没有明确。权力机关颁发的有关监督问题的条文是应急性的多,超前性的少;禁止性的多,预防性的少;约束性的多,强制性的少;临时性的多,长效性的少;治标性的多,治本性的少。二是随着改革开放和社会主义市场经济体制的建立,不仅人的观念发生了变化,而且在实践中也出现了许多新情况、新问题,使一些过去很清楚的政策界限,现在变得模糊起来。如敢闯敢冒与遵纪守法的界限,维护中央权威与发挥地方、部门积极性的界限等。又如,公费出国、公款宴请、行政事业性收费、集资摊派等,有时很难分清哪些是正当的、合理的,哪些是不正当的、不合理的。再如,关于“有利于”、“群众满意不满意、高兴不高兴”的问题,有的事情有利于本部门、本地区,很可能有损于其他部门、其他地区,此地群众满意、高兴,彼地群众有可能忧愁、扫兴。还有就是行政事业单位的菜蓝子费、误餐补助费等,财政无力负担,只好靠单位自己创收。创收的结果就很可能出现乱收费、乱罚款,或者利用权力和国有资产谋取小团体利益。所有这些,都给监督工作带来了困难。三是制度没有落实到行动上。如党的组织生活制度本来是监督党员干部,特别是监督领导干部的重要途径和有效措施,可是,一些领导干部却借口工作忙,经常不参加组织生活。据我省某市市委组织部调查,领导干部参加组织生活时有缺席的占%,很少参加的占%,有的甚至在规定的组织生活时间里安排其他行政会议。再如,有的领导干部行动不受约束,外出不向党组织报告,党组织和群众无法依照制度对其进行监督。

  四

  针对当前机关党内监督存在的种种问题,必须采取标本兼治的办法来加以解决,特别是在治本上狠下功夫。

  机关各级党组织和每个党员,要从马克思主义、毛泽东思想建党理论的高度、执政党的地位的高度、党领导改革开放和现代化建设成败的高度,去认识我们强化机关党内监督的重要性和必要性。要针对当前一些机关党员监督意识差、模糊认识多、纪律观念淡薄等问题,加强党的基本理论、基本知识的学习和思想教育工作,使每一个党员懂得:没有正确的、有力的、有效的监督,党的肌体就会受到毒瘤的摧残,党也就不可能领导人民夺取物质文明和精神文明建设的双胜利。在党内政治生活中,党员既要自觉参与监督,履行监督别人的职责,又要接受来自各方面的监督,规范、约束自己的行为。要树立敢于监督、善于监督和自我接受监督的信心和勇气,自觉做到实施监督理直气壮,接受监督诚恳谦虚。

  要完善和逗硬执行党内监督制度。制度可以制约、规范党员的行为,限制党内错误倾向的发生和发展,同时制度又为实施党内监督提供了客观依据,使其有章可循。我们有些党员,特别是一些领导干部之所以犯错误,甚至违法乱纪,走上犯罪道路,这当然主要应由本人负责,但是与我们机关党内监督制度不完善、执行不力也有很大关系。只有通过制定和执行一套科学、严密、可行的制度,才能形成党内良好的秩序,遏制党内各种不正之风的出现。党的十一届三中全会以来,我们党恢复和建立了不少好的党内监督制度,诸如:党的组织生活制度、党员民主生活会制度、党员谈心制度、滤布党员领导干部参加双重组织生活制度、党员请示汇报和检查监督制度、民主评议党员和党员领导干部制度、领导班子思想作风建设制度、“两公开一监督”制度、党风党纪检查制度、受理群众来信来访制度、领导干部离任审计制度、领导干部财产申报制度、领导干部外出报告制度、政务公开制度、机关党组织负责人参加或列席本单位行政领导会议制度、机关党组织负责人参与本单位干部考察选拔的制度、党内监督责任制度,等。还有的部门和单位结合自身实际,制定了诸如《廉政建设若干规定》,《不准接受可能对公正执行公务有影响的宴请,不准参加用公款支付的营业性歌厅、舞厅、夜总会等娱乐活动的规定》,等等。实践证明,这些制度都是行之有效的。但问题是,这些制度虽然已经建立,但还不够完善,也不够配套,更重要的是由于缺乏必要的法规、条例和实施细则,使这些制度很难操作、检查、发挥效力。因此,我们建议中央有关部门尽快起草制定一套完备的党内监督法规、条例和实施细则,使监督和被监督这两个方面都有章可循、有法可依、逐步实现党内监督的科学化、规范化、制度化。

  要拓宽监督渠道。只有不断拓宽监督渠道,建立起自上而下、自下而上、纵横交错、内外结合的监督网络,才能克服监督效果上的局限,消除监督的“空白区”和“中间地带”。当前,要坚持党内监督与党外监督的有机结合,形成有利于发挥整体功能的监督机制。一是要树立监督部门的权威性,使其更好地发挥职能作用。就目前监督体制来看,监督者必须受同级党委(党组)和上级监督部门的双重领导,其好处是对问题的处理可以通过多级斟酌比较稳妥,但是这种稳妥往往是对下级而言的,而对同级党委(党组)的监督则显得苍白无力。因为监督者是处于受支配地位的,很多事都要通过同级党委(党组)的同意与否才能决定,这种没有独立行使监督权力的情况,客观上使被监督者得不到有效监督。有些违法乱纪的案件有时也因官官相护或互通情况而使监督处于被动地位;有的案件因需一级一级同意而一拖再拖,最后也就不了了之。因此,要实行有效监督,似应探索建立一个独立垂直的监督体制。二是监督部门要各司其职,各负其责。机关党组织从加强对党员的教育、管理角度,抓好机关党内监督;纪检监察机关重点放在执纪执法,从加强党风廉政建设角度,抓好机关党内监督;组织人事部门重点放在管好用好干部,从加强领导班子思想作风建设角度,抓好机关党内监督。同时,又要注意互相协调,沟通联系,强化党纪、政纪、法纪和经济监督的统一协调,形成监督的整体合力。三是要充分发挥纪检机关的牵头作用。由于党的纪检机关在整个监督体系中属于最高层的监督,居于领导地位,可以建立以纪委牵头、各监督部门参加的联系会议制度,对执纪执法中的重大问题及时研究协调,在大要案件和疑难案件上统一认识、统一步调、统一行动,同步处理,平衡量纪。同时还要依靠人民群众的监督,加强舆论监督,公开批评和揭露各种腐败现象。就整个社会而言,必须推行社会公开监督,实行政务公开,增强工作的透明度,特别是对群众普遍关注的热点问题,如干部任免、住房分配、子女安排以及福利待遇等,应公开办事程序和结果;对有关加强监督的决定、制度,应广泛宣传,力求人人皆知;对违反党纪条规,尤其是在反腐败斗争中查处的重大案件,凡是可以公开的,都应当通过适当方式,尽量予以公开,以形成相互补充、相互协调的社会监督网络,发挥社会整体监督的效能,这样才能对我们的机关党员干部实行全方位、各层次、多形式的有效监督。

  机关各级党组织要切实负起对所属党员进行监督的责任,一级抓一级,层层落实监督工作责任制。一方面,机关党组织要定期召开党委会、支委会、党员大会,由本部门党员行政负责人通报一个时期的主要工作情况,沟通领导干部与党员的联系;督促领导班子定期召开民主生活会,督促党员领导干部根据党内外群众提出的主要意见进行整改,并将领导干部执行民主生活会制度、开展批评和自我批评的情况以及生活会上所反映出来的主要问题,如实地报告上级党组织;经常注意了解和掌握党员的思想、工作情况,依照有关管理范围,及时向党员行政领导报告,配合搞好监督。另一方面,党员行政领导干部要切实坚持“两手抓、两手硬”的方针,在履行领导职责的同时,也要履行好监督职责。要指导帮助机关党组织建立健全党内监督制度,吸收机关党组织的负责人列席有关行政会议和其他重要会议,在任免本机关的行政干部时应认真听取机关党组织的意见,自觉地把领导、管理与监督有机地结合起来,在研究、部署、检查、总结业务工作时,与监督工作一起研究,一起部署,一起检查,一起总结,积极配合和支持党组织做好对所分管单位的领导干部的监督工作,从而形成齐抓共管的局面。
