　 国际商会银行技术与惯例委员会副主席,中国银行张燕玲副行长第一个举手投下了代表中国金融界、企业界神圣的三票。

　 唯一的参会中国代表团。UCP600由ICC CHINA负责翻译，我国银行界唯一参与此项工作的是我行原河北分行杨士华行长，由他对中译本进行了最终审定。

　三、UCP600修订背景介绍

　 UCP500已使用十余年，有些条款已难以满足银行、运输、保险等行业发展需要。ICC于2002年萌发修订UCP500的动议。

　 自UCP500生效以来，向ICC提出的专家意见中超过58％集中在UCP500七个条款上。另有17条现行条款从未引起意见或只有一两条意见。

　2、交单

　相关定义

　银行工作日（banking day）:

　指银行在其履行受本惯例约束行为的地点通常开业的一天

　交单（Presentation ）：

　指向开证行或指定银行提交信用证项下单据的行为，或按此方式提交的单据

　交单人（ Presenter ）：

　指实施交单行为的受益人、银行或其他人

　指定银行（Nominated bank ）:

　指信用证可在其处兑用的银行，如信用证可在任一银行兑用，则任何银行均为指定银行

　第6条 截止日和交单地点

　除非UCP600第29条a款（遇节假日顺延）规定的情况，否则受益人或受益人的交单应在截止日当天或之前完成。

　规定承付或议付截止日将被视为交单的截止日。

　可在其处兑用信用证的银行所在地即为交单地点。可在任一银行兑用的信用证其交单地点为任一银行所在地。除规定的交单地点外，开证行所在地也是交单地点。

　当单据中包含正本运输单据

　第14条审单标准 如果单据中包含一份或多份正本运输单据，则须在不迟于发运日后的21个日历日内交单，且不得迟于信用证的截止日。

　第35条当报文，信件或单据按照信用证的要求传输或发送时，或当信用证未作指示，银行自行选择传送服务时，银行对报文传输或信件或单据的递送过程中发生的延误、中途遗失、残缺或其他错误产生的后果，概不负责。

　如果被指定银行确认单据相符并将单据寄送开证行或保兑行，即使单据在从被指定银行寄送到开证行或保兑行的途中遗失或从保兑行寄送到开证行的途中遗失，不论被指定银行是否承付或议付，开证行或保兑行必须承付或议付，或偿付被指定银行。

　相符交单：指与用证条款、UCP600 的相关适用条款及国际标准银行实务一致的交单

　第5条 单据与货物、服务或履约行为

　银行处理的是单据，而不是单据可能涉及的货物、服务或履约行为。

　对进口商影响

　不能以货物、服务或履约行为作为理由要求银行拒付

　第14条审单标准

　银行审据的时间：按指定行事的指定银行、保兑行（如有）及开证行各有从交单次日起的至多五个银行工作日…

　审单时间不因过效期或最迟交单期而缩短或受其它影响

　21天交单期的规定适用于正本运输单据

　单据审核的核心标准14.d:数据不得矛盾

　单据内容应符合其功能

　运输单据可以由承运人、船东、船长或租船人（charterer）之外的任何一方（any party）出具

　联络细节（传真、电话、电子邮件及类似细节）作为受益人和申请人地址的一部分时将不予理会。然而， 如果申请人的地址和联络细节为UCP600中规定的运输单据上的收货人或通知方细节的一部分时，应与信用证规定的相同。

　关于打印和拼写错误的总结：

　1）单词中的拼写或打字错误不构成另一个单词，从而不构成歧义的，一般不视为不符点。

　2）拼写或打字错误有可能导致歧义或产生实质性影响的……?

　3）ICC对信用证审单标准趋势……?

　第15条相符交单——新增条款

　当开证行确定交单相符时，必须承付。

　当保兑行确定交单相符时，必须承付或者议付并将单据转递给开证行。

　当指定银行确定交单相符并承付或议付时，必须将单据转递给保兑行或开证行。

　对进口商的影响-WHEN的含义

　开证行付款的时间为其确定单据相符时点

　第16条不符单据、放弃及通知

　发出拒付通知的时间：按指定行事的指定银行、保兑行（如有）及开证行在不迟于自交单之翌日起的第五个银行工作日

　退单时间（新增）：拒付单据处理方式中选择“持单候示”和“洽申请人放弃不符点”两种处理方式, 可在任何时间退单

　拒付通知中增加了两种单据处理方式

　 b.开证行留存单据直到其从申请人处接到放弃不符点的通知并同意接受该放弃，或者其同意接受对不符点的放弃之前从交单人处收到其进一步指示

　d.银行将按之前从交单人处获得的指示处理

　4.其他进行信用证欺诈的情形。

　信用证欺诈例外豁免原则

　第十条 人民法院认定存在信用证欺诈的，应当裁定中止支付或者判决终止支付信用证项下款项，但有下列情形之一的除外

　(一)开证行的指定人、授权人已按照开证行的指定善意地进行了付款

　(二)开证行或其指定人、授权人已对信用证项下票据善意地作出了承兑

　(三)保兑行善意地履行了付款义务

　(四)议付行善意地进行了议付

　受欺诈例外豁免原则保护的第三方

　1）保兑行

　保兑行如果仅仅作为保兑行，那么在其履行完独立于开证行的保兑责任，即

　付后将享有豁免权

　2）被指定付款/议付/延期付款/承兑行

　被指定行必须在开证行的授权范围内行事，同时必须善意地支付对价，这样才能受到豁免权的保护

　对开证申请人的影响

　如果信用证交易中未出现善意第三方

　开证申请人可申请当地法院向开证行下达止付令。但开证申请人必须向法院提交存在欺诈的证据并满足其它规定的条件（见《规定》第11条）

　（2）如果信用证交易中已存在善意第三方

　 依据“欺诈例外豁免”原则，开证申请人不应要求开证行对外止付，也不应申请法院向开证行签发止付令。从各国司法实践看，法院在这种情况下签发止付令往往难以阻止开证行的付款行为。因为，善意第三方往往可以通过直接起诉开证行或其分支机构而获得偿付，由此产生的费用最终也要由开证申请人承担。
