　 化解乡村债务的有效途径

　农村债务虽然不是农村税费改革本身带来的，但村级债务制约着农村税费改革向纵深推进，尤其是村级财务管理不规范，给村级债务化解工作带来更大难度。目前，村级债务形成主要有以下几个方面。

　 “普九”达标形成的债务。八十年代未至九十年中期，为了改善农村教学条件，对农村九年制义务教育实行硬性达标，而上级配套资金十分有限，大部分依靠乡村两级自筹，而筹资渠道主要是向农户集资和向银行借贷。因“普九”达标形成的债务在乡村债务中所占比例最大。

　村级兴办企业亏损形成的债务。部分村组为了壮大集体经济，靠借贷和集资兴办企业，因经营管理不善，产品质量不高，市场信息不灵，销售渠道不畅等众多因素导致企业亏损，以致于资不抵债形成的债务。

　完成各项税费和集资任务形成的债务。税费改革前，农户的负担项目非常多，除农业税、特产税和“三提五统”外，还有各种集资摊派，村组为了完成上级下达的任务，只有向银行和民间借贷完成各项税费任务，长此以往形成的债务(农户欠集体，集体欠银行)。

　当前，搞好村级债务化解工作是农村税费改革的一项重要任务。为此，笔者认为，对核实后的村级债权债务，要积极稳妥地逐步化解，具体化解方式要实事求是、灵活多样，要在政策、法律法规允许的范围内，大胆探索多种有效途径和方法。

　完善制度，锁定债务。首先从完善制度入手，锁定村级债务，制止新的不良债务发生。一是通过加强群众监督来健全财务管理，发挥村民理财小组的作用；二是严肃化债纪律，进一步加大对村级财务预算的控管和公开力度，通过制度约束达到锁定老债，不发生新债的目的。

　盘活资产，偿还债务。对村集体拥有的企业、基地、闲置房产等固定资产和“四荒”等资源，经村民代表会议讨论，进行资产评估和产权界定，可采取拍卖、租赁、承包等形式，综合开发利用，盘活存量资产，筹集资金用于偿还村组债务。

　削减高息化债。为了解决过去因借贷完成税费任务、发工资、保运转和兴办企业等借欠的高息借款，要在清理核实的基础上由当地政府出面协调，经双方协商，可从借款之日起，按照金融部门规定的同期同档利率，由乡镇农经部门确认后统一换据，过去已付息的高出部分，可以用于抵冲本金。村组要根据各自偿还能力，制定可行的化解债务的办法，同时，村组今后严禁高息借贷。

　清收债权化债。对有关单位和个人拖欠集体的款项，要根据不同对象和性质，分别采取经济、行政或法律手段等多种办法进行清收。一是对农户的税费尾欠和集资等欠款，要根据实际情况和承受能力，经村民代表民主评议，扣除不合理的部分，促其主动偿还。对暂无还款能力的或一次性交清有困难的，可由村与农户签订还款计划，分期偿还。对确实无能力偿还的农户，绝不能采取司法强制手段逼债和组织小分队上门强征、强要、强抢实物；二是对国家干部、村组干部、企事业单位职工及其家属的欠款，要限期清收。对有还款能力而拒不还款的单位和国家干部职工，可申请法院依法清收。对单位和个人长期占用集体资金和资产谋取私利的，要依法严肃查处。
